Conformity assessment of hot-water boilers burning liquid or gaseous fuels

 


The products specified in Regulation No. 25/2003 Coll. and in Section 12(1)(a) of Act No. 22/1997 Coll. are new boilers and components. The manufacturer or its authorized representativeis required under Act No. 22/1997 Coll. to place only safe products on the market. The technical requirements for the efficiency of new hot-water boilers burning liquid or gaseous fuels are defined in Government Regulation No. 25/2003 Coll.

Government Regulation No. 25/2003 Coll. (as amended) applies to:

  • boilers for liquid or gaseous fuels (consisting of a boiler body and a burner, intended for heating water using thermal energy obtained by burning liquid or gaseous fuel),
  • boiler components (i.e., a boiler body intended for assembly with a burner and burners intended for assembly with a boiler body).
Government Regulation No. 25/2003 Coll. (as amended) does not apply to:
  • boilers manufactured as individual units;
  • combination boilers capable of burning solid fuels;
  • instantaneous water heaters;
  • boilers for burning industrial gases, biofuels, etc.;
  • stoves and appliances intended primarily for heating the spaces in which they are located, with an additional function of supplying domestic hot water or hot water for heating;
  • appliances with a rated output of less than 6 kW and gravity circulation intended solely for the preparation of domestic hot water in a storage tank;
  • equipment combining the production of useful heat with the simultaneous production of electrical or mechanical energy in a single production process.
The conditions for placing boilers and components on the market and putting them into service are set forth in detail in Section 2 of Government Regulation No. 25/2003 Coll. Before being put into service, boilers must meet the technical requirements for boiler efficiency specified in Annex No. 1 to Government Regulation No. 25/2003 Coll.Conformity assessment

procedures are carried out in accordance with:
  • Annex No. 2 to Government Regulation No. 25/2003 Coll.
    – includes EC type examination (conformity assessment procedure B)
and
  • in accordance with one of the procedures specified in Annex No. 3 to Government Regulation No. 25/2003 Coll.
    :
    - conformity assessment procedure C (conformity to type),
    - conformity assessment procedure D (production quality assurance),
    - conformity assessment procedure E (product quality assurance).

An exception applied to conformity assessment procedures regarding technical efficiency requirements for gas-fired boilers, which until April 20, 2018, had to be carried out in accordance with Government Regulation No. 22/2003 Coll. This regulation was repealed on April 21, 2018, by Government Regulation No. 63/2018 Coll. ; Regulation (EU) 2016/426 of the European Parliament and of the Council on gas-fired appliances and repealing Directive 2009/142/EC now applies.

Module B: EC Type
Examination
A notified body verifies and certifies that a representative sample, representative of the intended production, complies with the relevant provisions of Government Regulation No. 25/2003 Coll. The manufacturer or its authorized representative shall submit an application for EC type examination to the notified body of its choice. The requirements for the application are described in Annex No. 2 to Government Regulation No. 25/2003 Coll
. The technical documentation must enable an assessment of the equipment’s conformity with the requirements of Government Regulation No. 25/2003 Coll. Details of the technical documentation are also specified in Annex No. 2 to Government Regulation No. 25/2003 Coll. The notified body shall examine the technical documentation, verify that the equipment type has been manufactured in accordance with the documentation, and, where necessary, perform or have performed additional tests and appropriate verifications where harmonized technical standards (hEN) have not been applied and where such standards have been applied. If the type complies with the relevant provisions of Government Regulation No. 25/2003 Coll., the notified body shall issue an EC type-examination certificate to the manufacturer or its authorized representative. The certificate shall contain identification data on the manufacturer or, where applicable, its authorized representative, the conclusions of the examination, and the necessary data for identifying the certified type. If any change is made to an approved boiler or component, the manufacturer or authorized representative shall inform the notified body and request additional approval, which is confirmed by an amendment to the original EC type-examination certificate.
The manufacturer or its authorized representative shall keep copies of the EC type-examination certificates and their amendments together with the technical documentation for a period of at least 10 years from the date of the last manufacture of the relevant product.
If the manufacturer is not from the EU and has no authorized representative, the person placing the relevant product on the market is responsible for providing the conformity assessment documents upon request by the supervisory authority.

Module C: Conformity to Type
The manufacturer shall take all necessary measures to ensure that the manufacturing process ensures the conformity of the manufactured equipment with the type described in the EC type-examination certificate and with the requirements of Government Regulation No. 25/2003 Coll. The manufacturer or its authorized representative ensures and declares that the equipment in question is in conformity with the type described in the EC type-examination certificate and meets the requirements of Government Regulation No. 25/2003 Coll. The manufacturer ensures that the manufacturing process ensures the manufactured boilers or components conform to the type described in the EC type-examination certificate and to the technical efficiency requirements. The manufacturer or its authorized representative affixes the CE marking to each device and draws up a written declaration of conformity. The manufacturer or its authorized representative shall retain a copy of the declaration of conformity for a period of at least 10 years after the manufacture of the last product. A
notified body, selected by the manufacturer, shall carry out or have carried out product tests at random intervals. If one or more of the randomly selected samples of the finished product do not comply with the requirements of Government Regulation No. 25/2003 Coll., the notified body shall take appropriate measures. If the manufacturer is not from the EU and has no authorized representative, the person placing the relevant product on the market is responsible for providing the conformity assessment documents upon request by the supervisory authority.

Module D: Production Quality Assurance The manufacturer submits an application to the notified body of its choice for the assessment of its production quality system for the relevant boilers or components. The production quality assurance system must ensure that the boilers or components conform to the type described in the EC type-examination certificate and to the requirements of Government Regulation No. 25/2003 Coll. that apply to them. The notified body shall assess the production quality assurance system, and this assessment must include an inspection of the manufacturing facility.
The manufacturer fulfills the obligations under the approved quality system for production, final inspection, and testing of the equipment, ensures and declares that the equipment is in conformity with the type described in the EC type-examination certificate and meets the requirements of Government Regulation No. 25/2003 Coll. The manufacturer is subject to surveillance by the notified body. For the purposes of surveillance, the manufacturer shall grant the notified body access to the production, inspection, testing, and storage areas, as well as to the necessary documents specified in Government Regulation No. 25/2003 Coll. The requirements for the production quality system documentation are defined in Annex No. 3 to Government Regulation No. 25/2003 Coll. The notified body shall carry out regular surveillance, as well as unannounced surveillance, at the manufacturer’s premises regarding compliance with the production quality system. The notified body shall provide the manufacturer with a report on the results of the surveillance. The manufacturer or its authorized representative shall inform the notified body that approved the quality system of any intended changes to the production quality system. The notified body shall assess the intended changes and decide whether the modified production quality system will continue to meet the requirements set forth in Government Regulation No. 25/2003 Coll., or whether a new assessment is necessary. The manufacturer or its authorized representative shall affix the CE marking to each appliance and draw up a written declaration of conformity. The CE marking shall be accompanied by the identification number of the notified body responsible for surveillance.
The manufacturer shall retain the necessary documentation, reports, decisions, and updates for a period of at least 10 years from the date of the last production of the relevant product.

Module E: Product
Quality Assurance
The manufacturer shall submit an application to the notified body of its choice for an assessment of the quality system for the boilers and appliances it manufactures.

The application must include relevant information on the boilers and components, documentation on the product quality assurance system, technical documentation for the certified type, and a copy of the EC type-examination certificate. Each boiler or component is tested within the quality system in accordance with harmonized technical standards, or equivalent tests must be performed to verify compliance with the technical efficiency requirements. The manufacturer must systematically document all measures in the form of written instructions, procedures, and guidelines. The manufacturer fulfills the obligations under the approved quality system for final inspection and testing of boilers and appliances, ensures and declares that the boilers and appliances are in conformity with the type described in the EC type-examination certificate.  The manufacturer or its authorized representative established within the Community shall affix the CE marking to each appliance and draw up a written declaration of conformity. The CE marking shall be accompanied by the identification number of the notified body responsible for surveillance.  The manufacturer shall keep the necessary technical documentation regarding the product quality system, reports, decisions, and updates for a period of at least 10 years from the date of the last production of the relevant boiler or component.

CE Marking and Other Markings
: Boilers and components, provided they meet the requirements of Government Regulation No.
25/2003 Coll., may bear the CE marking. Boilers and components may also bear a marking other than the CE marking, but the visibility and legibility of the CE marking must be maintained.
Note: Government Regulation No.25/2003 Coll. contains a reference to the now-repealed Government Regulation No. 291/2000 Coll., which established the graphic form of the CE marking. Under the new horizontal legislative framework, the conditions for affixing the CE marking are described in Decision No. 768/2008/EC of the European Parliament and of the Council, as amended on July 1, 2015, and further in the relevant regulations and related harmonized standards.
