Czech Republic Regulations on Toys
Since toys, as defined in Section 12(1) of Act No. 22/1997 Coll. on technical requirements for products and on amendments to certain acts, so-called “specified products,” for which conformity of their characteristics must be assessed upon placing them on the market in accordance with the relevant implementing regulation to this Act—and this implementing regulation is Government Regulation No. 86/2011 Coll. on technical requirements for toys—the provisions of this regulation must be complied with when placing products on the market in the Czech Republic. This regulation implements Directive 2009/48/EC of the European Parliament and of the Council into our legal system. Government Regulation No. 86/2011 Coll. repealed and replaced Government Regulation No. 19/2003 Coll. (as amended by Government Regulations No. 340/2008 Coll. and No. 1/2010 Coll.) as of July 20, 2011. This Government Regulation No. 19/2003 Coll. could be used during the transitional period from July 20, 2011, to July 20, 2013, to determine the chemical properties of toys pursuant to
Section 25(2) of Government Regulation No. 86/2011 Coll.
(Section 25(2) of this regulation corresponded to the requirements of Part II, point 3, of Annex II to Directive No. 88/378/EEC), which remained in force during this transitional period). Now, toys must meet the requirements regarding chemical properties set forth in Part III of Annex 2 to Government Regulation No. 86/2011 Coll.
